WorldGardensCafe, LLC ("WGC") respects the privacy of every individual and is committed to protecting your privacy. This Privacy Policy provides information on the manner in which your personal information obtained through your use of www.worldgardenscafe.com  or related sites (together, the "Website") is processed and used on this Website. WGC uses your personal information only in ways that are compatible with this Privacy Policy. In addition to reviewing this Privacy Policy, please read our Terms and Conditions of Use. Your use of the Website constitutes agreement to its terms and conditions. This Privacy Policy does not cover information collected on sites linked to from the Website.

Information Collected. WGC collects personal information from you (for example, your name, postal address, email address, and other data) when you provide personal data through our Website. The Website generally collects personally identifying information with your specific knowledge and consent. For instance, when you complete a survey, make a purchase, or register for any portion of our services, you are asked to provide information such as your email address, name or phone number. Optional information such as your age or gender may also be requested. WGC does not sell the email addresses of its customers.

This website does not respond to Do Not Track signals.

Third Party Access. We allow access to our database by third parties that provide us with services, such as technical maintenance and search software, but only for the purpose of and to the extent necessary to provide those services. If you choose to purchase items through features on our Website, we may forward your information to third parties for services such as credit card processing and order fulfillment. There also may be occasion when we are legally required to provide access to our database in order to cooperate with investigations or other legal proceedings. In those instances, the information is provided only for that purpose. While your individual information is protected as outlined above, we reserve the right to use, transfer, sell, and share aggregated, anonymous data about our users as a group for any business purpose, such as analyzing usage trends and seeking compatible advertisers and partners.

Use of Information. Your information is stored in a secured database and is used for purposes of providing you with information requested by you, providing for a follow up with you in connection with materials you request and as a part of our mailings and solicitations to prospective customers. The information you provide also may be utilized for market research purposes. Please note that all email that originates from us will either display the www.worldgardenscafe.com domain name or an affiliated domain name.

Unsolicited Email (SPAM). You should be aware, however, that unscrupulous marketers can sometimes "harvest" your email address directly from your computer or another person’s address book or even obtain your email address through programs that automatically search web pages and email traffic for email addresses. WGC also may disclose or exchange with others information you have provided to us if we believe that the law requires us to do so or if it is necessary to protect the rights or property of WGC, our affiliate companies, our staff, or our users.

Information Automatically Collected. In addition, we automatically receive and collect certain types of information whenever you visit our Website. For example, like many websites, we use "cookies" and web beacons to obtain certain types of information when your web browser accesses our Website. We use this information to monitor the usage and performance of our Website, to enhance our customers’ search and shopping experiences and to determine aggregate information about our user base and usage patterns. We also use your IP address to help diagnose problems with our server, to administer our Website, and to communicate with you after you have sent us emails. If you send us emails, from time to time we may use information about your preferences and interests to send updates to you about WGC, its services, listing, special offers, or information that may be of interest to you.

Security. WGC will use reasonable precautions to keep the information disclosed to us secure and not to disclose such information to any third parties. WGC is not responsible for the privacy policies of other sites.

Children. This Website is directed to adults and is not directed to children under the age of 18. WGC complies with the Children's Online Privacy Protection Act and does not permit registration by and will not knowingly collect personally identifiable information from anyone under 18. This Privacy Policy will be posted on the Website.

Changes to Information. We need your help in making sure your personal information is correct in our systems. Please notify us of changes to your name, address, title, phone number or email address. You may correct your personal information or select the option not to receive future WGC contacts (for example, mailings, calls, etc.) by emailing us at the address below. In the event you elect not to receive any future contacts WGC, we will endeavor to remove your name from all of our contact lists. We shall have no liability under this Privacy Policy for our failure to accomplish this objective.

Your Consent. By using our Website, you consent to the collection, use and disclosure of information in accordance with the terms of this Privacy Policy. We reserve the right to modify or amend this Privacy Policy at any time. If we change our Privacy Policy, we will post any changes on this page.

IP Address. Your Internet Protocol ("IP") address is usually associated with the place from which you enter the Internet, like your Internet Service Provider, your company or your university. We may use your IP address to help diagnose problems with our server, gather broad demographic information, and administer our Website.

Our Security Policy

Online security is important to World Gardens Café, so we have taken precautions to make the entire experience safe and secure using the most sophisticated security available. Some security measures include: protect personally identifiable information collected against unauthorized access, disclosure, alteration or destruction; keep personally identifiable information accurate and up-to-date, consistent with applicable law. Although, no security system can guarantee security entirely for the transmission of data, we use technology to protect the personally identifiable information that you transmit to us via our site.

  • Secure Sockets Layer protocol (SSL) The most advanced security system available on the Internet. SSL helps protect your Internet communications through server authentication, encryption and data integrity. All personal information sent over SSL pages is encrypted so that it cannot be read as it is transmitted.
  • User name and password protection Bars unwanted parties from viewing or tampering with your information.
  • Fire Wall Protection Prevents "hackers" from directly linking their computer systems to Fraud Fighter, disallowing any attempt to manipulate, change, erase, or damage your data which we keep inside the firewall.

World Gardens Café does not keep any personal information for a longer period than is needed for the purposes described herein. We do not sell or rent visitors’ collected personal information to third parties. You may call or e-mail at any time to request a summary of the personal information we have currently on record regarding you, the user and your recent visits to the site. With the exception of the personal information needed to complete a purchase and secure payment, we will dispose with and destroy any personal information about you, the user, upon request.

Terms and Conditions

ALL PURCHASES FROM THE WEB STORE (“WEBSITE”) AT WWW.WORLDGARDENSCAFE.COM ARE SUBJECT TO THESE SALES TERMS. IF YOU DO NOT AGREE TO ANY OF THESE TERMS, WE WILL NOT BE ABLE TO ACCEPT YOUR ORDER. THE WEB STORE IS OPERATED BY WORLD GARDENS CAFE, LLC ("MERCHANT"), AKA (“WGC”).

BINDING AGREEMENT. These are the Terms and Conditions which also contain billing terms for World Gardens Cafe meal preparation and delivery programs. WGC provides its services to you subject to these Terms and Conditions (whether while ordering on the website or as provided via telephone). By ordering any of our meals, meal plans, meal packages, or using the WGC site (www.worldgardenscafe.com), you agree to be legally bound and abide by these Terms and Conditions, just as if you and WGC had signed an agreement containing these Terms and Conditions. We reserve the right, in our sole discretion, to change, modify, add or remove portions of these Terms and Conditions at any time. By using this website after we post any changes to these Terms and Conditions, you agree to accept those changes, whether or not you have reviewed them. By agreeing to these Terms and Conditions you also agree to receive our newsletters and special offers.

CORRESPONDENCE. I understand each communication with customer service will result in a confirmation email. If I send an email to customer service I will receive a confirmation email within 24 business hours. If I do not receive a confirmation email within 24 hours, I agree to immediately follow up with WGC customer service.

PRODUCTS. Product availability, product descriptions and product prices are subject to change by Merchant at any time without prior notice. Some product descriptions and product images on Merchant’s website, or printed menus, or brochures, or advertisements, may be changed at any given time, may be not be current at any given time, and may have been provided by other vendors. Merchant does not independently verify the accuracy of such product descriptions by other vendors. Merchant makes commercially reasonable efforts to keep product information current, but some information may be out of date from time to time. Certain weights, measures, nutritional data, and similar descriptions are approximate and are provided for convenience only. All publications are for marketing purposes, personal convenience, and may not be copied for further distribution or sale.

Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Also, consult your physician or other qualified health provider before beginning any dietary program. You assume all risks arising from your use of any dietary program or instructions provided through the Website, including purchase from the Website, or via telephone, or in person, with our Executive Chef, Nutrition Adviser, Health Consultant, Operations Manager, or Customer Service personnel.

WEIGHT LOSS. Weight loss will vary for each client based off their individual weight, metabolism, age, activity level and commitment to their meal plan and/or products.

ALLERGIES. If you have a life-threatening allergy please refrain from ordering WGC Programs. Our kitchen is Certified Gluten-Free and all meals are prepared with that requirement and purpose observed. While the general facility, in which WGC resides and operates, contractually permits other companies to produce products that may contain gluten, WGC cooking staff strictly observes the requirement to purify the ambient air with HEPA filters for a minimum of two (2) hours after any other company has prepared food products that may include gluten ingredients, and sterilizes all food preparation tables prior to WGC’s staff usage. All meals are also dairy-free, and can also be prepared as  soy-free upon specific request and approval by our Executive Chef. Our meals are produced in a facility that also handles eggs, dairy, soy, nuts and tree nuts. Any known food ingredient intolerances or allergies must be communicated to our Customer Service personnel and Executive Chef prior to completing an order. Reasonable efforts will be undertaken to accommodate specific diets or such issues (as noted above) as long as our Executive Chef has determined that he/she can modify any given recipe, or meal,  accordingly. However, Merchant (WGC) and its personnel, namely our Executive Chef, and/or Nutrition Adviser, and/or Health Consultant, and/or Operations Manager, on behalf of WGC, reserve the right to refuse to prepare any meals that are requested to be customized according to a customer’s food preferences, food intolerances, or food ingredient allergies

ELIGIBILITY. This website (Web Store) is offered and available to users who are 18 years of age or older, and reside in theUnited States. By using this Website, you represent and warrant that you are of legal age to form a binding contract with the Company and meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Website.

ORDER ACCEPTANCE AND SHIPPING. All orders submitted through the Web Store, through person-person contact, or by calling Customer Service, are subject to acceptance by Merchant at its location or corporate headquarters. Merchant will issue an electronic confirmation of order receipt. Confirmation of order receipt does not constitute acceptance by Merchant. Merchant may accept an order in a written acceptance or by processing payment for or fulfilling the order. Products will be shipped only to locations in California, Arizona, Nevada, or Utah. Merchant cannot ship to post office boxes; we require a street address for shipping. Neither Merchant nor any vendor will be responsible for fulfilling orders that cannot be shipped because of incomplete or inaccurate billing or shipping information. Our policy is to not deliver on weekends or on holidays; exceptions to this must be done with the approval by the Executive Chef and/or Operations Manager, and may incur a special extra fee, and are not guaranteed. Merchant will observe its procedure to properly ship all frozen orders which may involve enclosing products in insulated materials or containers/boxes, and with sufficient quantities of dry ice, or regular ice, as needed. Customers must accept the responsibility of insuring that a person will be available to receive frozen meal shipments during the times specified by Merchant and to maintain their frozen state. If Customer cannot arrange for this then they must notify Merchant 24 hours in advance of delivery pick up (initiation) by Merchant, or its contracted shipping vendors; in such instances, Customer may verbally permit Merchant, or contracted outside shipping vendor, to leave a shipment on the customer’s home or business premises unattended.  Such permission by Customer - to allow a shipment to remain unattended at their designated location - will documented by Merchant and clearly releases Merchant (WGC) of ALL responsibility of the condition of the products, including, but not limited to, the frozen state of the meals, and to potential theft of the same. Refunds or replacements will not occur once Merchant’s responsibility has been released.

INITIAL ORDER. Once you place an initial order, WGC will process your order within 24 hours. Depending on current availability, your meals may be ready for pick-up or delivery within 1 to 5 days.  WGC strives to have sufficient inventory on hand at all times, but there may be variance due to ingredient availability, food preparation requirements, holiday schedules, etc. and thus reserves the right to extend meal delivery dates. Food preparation is intensive due to the nature of our gourmet, gluten-free, dairy-free requirements, occasional special meal orders, and our Chefs and cooking staff are usually in various stages of multiple meal preparation. Therefore, once you (as customer) have placed your order, your order cannot be changed or stopped, and you agree to accept the initial order.

REOCCURRING ORDERS. For clarity, our Auto-delivery Program is voluntary and is one contract between you and WGC for the reoccurring shipping of our products rather than a series of separate contracts. All plans are automatically renewed each week. Reoccurring charges will be processed every Tuesday after the Monday 5:00 pm PST deadline. You will be billed weekly (or by other arranged, agreed upon schedules) the standard price listed on our website plus shipping. This charge will be for the following week's delivery. If you do not wish your plan to renew automatically, you must contact Customer Services at (800) 381-8219 prior to our posted deadlines.

DEADLINES.  All current customers on recurring orders have until Wednesday at 5:00pm PST, PRIOR to the next week's shipment, to cancel or reschedule delivery. In some cases a little more than a week in advance for special orders. Because we offer fresh frozen entrees we cannot allow entrees to be refused or returned.

SCHEDULE CHANGES. You are able to place your reoccurring order on vacation hold or cancel your orders as long as your requests are made within WGC’s deadlines. Placing your order on a vacation hold could deactivate any ongoing coupons you might have used. You understand if you place a request to cancel your program after WGC's above deadline you agree to accept/receive your final shipment.

MENU CHOICES. WGC makes every reasonable effort to deliver items you've requested for your order. A La Carte orders are chosen by you, the customer. Note that meals ordered as a “Sampler” Package are not chosen by you; they are selected by our Chef and/or our cooking staff.  Nevertheless, WGC will observe a special general request (eg. “no beef”, or “no chicken”) to the best of our ability. Please note that product availability may change without notice. Product availability changes may delay part or all of an order due to the circumstances as described in the “Initial Order” section above. WGC reserves the right to substitute a similar item in your order, based upon your approved entrees.

PRICE AND PAYMENT. Product prices are subject to change from time to time by Merchant without prior notice. The price charged by Merchant for any product will be the price listed for such product in the Web Store (website) listings at the time an order is submitted to Merchant. Product prices do not include shipping and handling fees or sales taxes. Merchant will add shipping and handling charges to your order. If Merchant is required to collect sales tax from you, Merchant will also add sales tax to your order. Orders must include current, valid credit or debit card information. By submitting an order to purchase products through the Web Store/website, or on pre-printed WGC forms, or verbally via telephone with our staff, you authorize Merchant to charge to the credit or debit card identified in your order the price for all products purchased in the order, plus all applicable shipping and handling charges and taxes. Payment by check (made out to “World Gardens Café”) or cash will be permitted only for orders being picked up at our kitchen location.

REFUND/REPLACEMENT POLICY. Because we offer a customized fresh-frozen perishable program, we cannot accept returns or permit delivery cancellation for any reason after deadlines for changing your next week's orders, or new orders. If there are errors on your order, or any are damaged, you need to contact Customer Service as soon as possible during office hours which are: Monday through Friday, 9:00 AM – 5:00 PM. Voice messages may be left on our phone ((800) 381-8219) at any time but will not be heard until the next working day. WGC policy is to replace any incorrect or damaged item if it was our responsibility. If there are extenuating circumstances where a replacement is not possible, WGC will arrange a refund for incorrect or damaged meals shipped. If there is damaged product, clearly caused by WGC,  in your order you need to contact Customer Service to arrange a replacement or refund for damaged product. Refunds will be made to you in the form of a check, or refunded to your credit or debit card whichever is chosen by WGC. Damage due to shipping problems or shipping delays are the responsibility of the carrier which could be the WGC staff, or a contracted shipping vendor. If WGC identifies that it was the fault of a contracted vendor then you must file a refund claim from that vendor.

LIMITATION OF LIABILITY. The liability of Merchant and its owners, officers, employees, agents, successors or assigns (the "Merchant Parties") to any purchaser or any other person for any claim arising in connection with a purchase through the Web Store shall be limited to actual damages in an amount not to exceed the purchase price paid to Merchant for the product or transaction from which the claim arises or to which it relates. In no event shall any of the Merchant Parties be liable to any purchaser or to any person claiming by, though, under or on behalf of purchaser, for any indirect, special, punitive, incidental or consequential damages regardless of the legal theory on which such damages are claimed and whether or not any of the Merchant Parties were advised of the possibility of such damages. Merchant is not liable for damage to any shipment once it has been delivered to a customer’s address.  Merchant is not liable for the theft or damage to a shipment if a customer requested that it can be left unattended at a customer’s address or otherwise designated location or facility.

MODIFICATION. These Web Store Sales Terms may be modified from time to time by Merchant without prior notice.

GOVERNING LAW. Merchant is located inCalifornia, and all orders are submitted to and subject to acceptance by Merchant at its location. All use of, and purchases made through, the Web Store shall be governed by the laws of the State of California without regard to any rule that would require the law of any other jurisdiction to be applied. Any legal or equitable action with respect to the Web Store or any purchase made through the Web Store shall be brought only in a federal or state court located inSan Bernardino County,California. To the fullest extent permitted by applicable law, no action brought by any individual with respect to the Web Store or any purchase made through the Web Store shall be joined with an action involving any other person who may assert similar claims with respect to the Web Store or any other purchase made through the Web Store.

LIMITATION ON CLAIMS. Any claim or action that any party may have arising from or related to use of the Web Store or any purchase made through the Web Store must be filed within 90 days after the claim or cause of action arises. Any claim or action not filed within such time will be forever barred.

REVERSED CHARGES. Customer agrees if they dispute a charge with their credit card company to pay any charge back costs incurred related to reversed charges as well as the initial charge the customer is disputing.

WAIVER AND SEVERABILITY. No waiver by the Company of any term or condition set forth in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Company to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.

If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Use will continue in full force and effect.

DISCLAIMER. OTHER THAN EXPRESS WARRANTIES, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MERCHANT DISCLAIMS ALL PRODUCT-RELATED WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. MERCHANT DOES NOT WARRANT THE ACCURACY OR COMPLETENESS OF ANY PRODUCT DESCRIPTION OR OTHER INFORMATION PROVIDED IN THE WEB STORE. MERCHANT DISCLAIMS ALL LIABILITY FOR PRODUCT DEFECTS, PRODUCT MISUSE OR ABUSE, IMPROPER PRODUCT SELECTION OR NON-COMPLIANCE OF ANY PRODUCT WITH APPLICABLE LAWS OR REGULATIONS. THIS DISCLAIMER SHALL BE LIMITED TO THE EXTENT (IF ANY) THAT IT IS PROHIBITED BY APPLICABLE LAW.
